Whole life tariff sentences are not legal for juveniles in the UK. The Criminal Justice Act 2003 states that juveniles who receive a mandatory life sentence must start at a minimum of 12 years, rather than the 15 or 30 year starting points set out in Schedule 21. The court must also consider the seriousness of the offense when setting the minimum term. In general, life imprisonment is only available to defendants aged 18 and over in England and Wales. Those under 18 may receive an indeterminate sentence, which means they are detained at His Majesty's pleasure. However, juveniles may be given longer custodial sentences for serious crimes, such as those that are violent or sexual. The European Court of Human Rights (ECHR) judgment in the case of Thompson and Venables in 1999 found that the applicants had been denied a fair hearing and that their detention was unlawful. The court ruled that it was unlikely that the applicants would have been able to consult with their legal representatives during their trial due to the tense atmosphere and public scrutiny. The court also considered their immaturity and emotional state at the time. The court found that the applicants had no opportunity to have a judicial body assess the lawfulness of their detention since their conviction in 1993. However, the court did rule that their sentence of detention at Her M P was lawful. As a result of the case, children now have more protections during trials. The applicants were also awarded legal costs, with Thompson receiving £18,000 and Venables receiving £32,000. The boys were ordered to be detained “at her majesty's pleasure” - meaning indefinitely. However, in 2001 a six-month review by the parole board found they were no longer a threat to public safety and they were released on life licence after serving just eight years.
